Belgian Citizenship: Disability or Retirement
At a glance
After five years of legal residence in Belgium, you may qualify for a citizenship declaration if you have reached pensionable age or can prove you cannot work because of a disability. This category uses different evidence from the usual work, language, and integration tests.

- An unlimited right to remain in Belgium is required when filing
Summary
Adults who have reached pensionable age or cannot work because of disability or invalidity can apply for Belgian citizenship through a dedicated declaration category. It still requires five qualifying years of legal residence, a main home in Belgium and an unlimited right to remain at the time of filing.
The municipality may require proof from a responsible medical, pension or social-security authority. A diagnosis or unemployment alone is insufficient, so confirm the accepted evidence before arranging reports. This is a citizenship process with different evidence from the ordinary work, language and integration category; it does not provide a residence permit or disability benefit.
-
Confirm the residence requirements Check the five-year legal residence history, Belgian main residence, and unlimited residence right at filing.
-
Obtain the accepted category evidence Ask the commune which official proof establishes inability to work through disability or invalidity, or attainment of pensionable age.
-
File the nationality declaration Prepare the civil and identity records and follow the commune’s complete-file and review procedure.
This category replaces specified language, integration, and work evidence; it does not remove the residence requirements. A diagnosis or unemployment alone does not establish the category.
Eligibility
The applicant generally needs to show:
- Age 18 or older.
- Main residence in Belgium.
- Five years of legal residence immediately relevant to the declaration.
- An unlimited right of residence at the time of filing.
- Either inability to hold employment or pursue an economic activity because of disability or invalidity, or attainment of pensionable age.
- Identity, civil status, residence history, and the official proof requested by the commune.
The commune checks the legal-residence periods and current status. It may ask for a decision or certificate from a responsible medical, social-security, pension, or other public authority rather than a private note alone. Applicants should ask the commune for its accepted evidence before arranging medical reports.
FPS Justice currently lists a €1,000 federal acquisition fee, paid before filing and legally subject to indexation. Additional record, translation, and local costs may apply.
More about this route
This remains a residence-based citizenship route. The applicant must have legally resided in Belgium for five years, have their main residence there, and hold an unlimited right of residence when filing. The disability, invalidity, or pension condition replaces the ordinary language, social-integration, and economic-participation requirements listed for the standard five-year category in the official FPS Justice overview.
The commune decides what official evidence is sufficient for the applicant's stated basis. A general medical condition or unemployment is not necessarily the same as legal inability to work because of disability or invalidity.
What This Route Allows
An accepted declaration results in Belgian nationality. The person can obtain Belgian identity and passport documents, live and work in Belgium without a residence permit, and exercise EU citizenship rights.
Belgium allows multiple nationality, although another country's law may attach consequences to voluntarily acquiring Belgian nationality.
What This Route Is Not
This is not a disability benefit, pension application, residence permit, or route available from abroad. It does not create five years of qualifying legal residence where that history is missing.
It is also not enough simply to have a disability diagnosis or to be out of work. The official category refers to inability to work because of disability or invalidity, or reaching pensionable age, and the Belgian authority must accept the proof.
At filing, the applicant must be an adult and hold an unlimited right to stay. For a route requiring language knowledge, a willingness to learn later is insufficient; accepted social-integration evidence can also establish language knowledge under the official rules.
Next Steps
- Ask the commune to confirm the five-year legal-residence calculation and that the current residence right is unlimited.
- Ask for the commune's written checklist for disability, invalidity, or pension-age evidence.
- Obtain the relevant public-authority decision, pension record, or accepted medical and social-security documentation.
- Gather the family-status and identity records required for the declaration, with legalization (official checks confirming a document's origin for use abroad) or translation where requested.
- Confirm and pay the current indexed federal fee through the official channel.
- File before the civil registrar in the commune of main residence.
- Keep the acknowledgment of a complete file. The royal prosecutor has four months from that acknowledgment to object, while the Immigration Office and State Security are also consulted.
