Summary
If you are married to an Ecuadorian citizen or have a legally recognized partnership with one, you can apply directly for permanent residence. You do not need to spend 21 months on temporary residence first.
Your relationship must be genuine and legally recorded. A marriage abroad normally needs registration for use in Ecuador, and a partnership must have the recognition Ecuador requires. The official marriage-based procedure also includes an interview.
-
Confirm your relationship qualifies Your spouse or legally recognized de facto partner must be an Ecuadorian citizen for the route covered here.
-
Complete the required relationship registration Complete the required Ecuadorian registration or recognition and prepare evidence of a real, continuing relationship.
-
Apply for permanent residence Submit the family and immigration documents, show lawful support and complete the required relationship interview.
This family basis can lead directly to permanent residence; it does not require 21 months on a temporary visa first. Approval still requires the complete immigration review.
Eligibility
You need to show that:
- The applicant is not already an Ecuadorian citizen.
- The other person is an Ecuadorian citizen, not merely a temporary or permanent resident.
- The couple has a legally valid marriage or an Ecuador-recognized de facto union.
- A marriage or union created abroad is registered or otherwise legally recognized for the Ecuadorian application.
- The relationship is real and continuing. The couple must be prepared for the required relationship interview and for reasonable supporting evidence.
- The applicant can show lawful financial support.
- The applicant meets the general immigration requirements in force when filing, including a valid travel document, lawful immigration status, required criminal-record evidence, and authentic civil records.
For a marriage case, the official procedure specifically identifies the Ecuadorian marriage registration and an interview with the couple. A foreign certificate alone may not complete the Ecuadorian civil-registration step. For a de facto union, confirm with the Civil Registry and Cancillería which recognition record is accepted; do not assume that an informal partnership or a private cohabitation agreement is enough.
Documents issued outside Ecuador may need an apostille or consular legalization and a Spanish translation. Requirements depend on the issuing country and the document. Names, dates, marital status, and identity numbers should agree across the passports, Ecuadorian citizenship record, marriage or union record, and application.
What This Route Allows
Approval gives the foreign spouse or partner Ecuadorian permanent residence on the family basis. A permanent resident can make Ecuador their home, obtain the Ecuadorian resident identity document, and exercise the rights Ecuadorian law gives foreign residents, including lawful work. The residence status is not tied to a particular employer or investment.
Permanent residence also creates a stable immigration position for later applications, but each later benefit has its own rules. In particular, naturalization through marriage or a registered union is a separate application. The official spouse-naturalization procedure uses a two-year period from an Ecuadorian marriage, or from registration in Ecuador of a marriage or union created abroad, together with living in Ecuador and holding a qualifying residence category. Permanent residence approval does not itself grant citizenship.
Immigration residence and tax residence are different. Living in Ecuador can trigger Ecuadorian tax-residence rules based on days, economic interests, or family connections. The SRI, Ecuador's tax authority, publishes the official rules; obtain tax advice if income or assets cross borders.
What This Route Is Not
Dating, engagement, or living together without a legally recognized union is not enough. This page covers spouses and partners of Ecuadorian citizens; spouses of foreign permanent residents and other relatives have separate rules to check.
This is a direct permanent-residence route, not a temporary visa that automatically changes after 21 months. You still need an approved application, valid records, and a real, continuing relationship.
Approval does not give you citizenship or decide tax, professional-licensing, or obligations under another country’s law.
Next Steps
- Confirm the partner is an Ecuadorian citizen and obtain a current Ecuadorian identity or citizenship record.
- Ask the Civil Registry or the responsible Ecuadorian consulate whether the marriage or de facto union is already recorded in the form needed for immigration. Complete that step before relying on the route.
- Compare every civil record for differences in names, dates, prior marital status, or parent details. Correct material inconsistencies rather than explaining them only after filing.
- Download the current spouse permanent-residence checklist from the official service page. Confirm the passport, criminal-record, immigration-status, and translation/legalization requirements for the filing location.
- Prepare for the couple's interview with genuine relationship evidence. Do not create or embellish evidence.
- Apply through e-VISAS and keep lawful status while the application is pending.
- After approval, follow the Civil Registry instructions for the identity card and ask Cancillería how changes in civil status must be reported.
