Summary
If you are an EU, EEA, or Swiss citizen, you can use European movement rights in Spain. A stay of up to three months generally requires a valid passport or national identity document. For longer residence, you need an eligible reason to stay and must register.
Registration produces a certificate stating the foreigner identity number (NIE), name, nationality, address, and registration date. It is not a photo identity card, so the citizen normally uses it with a passport or national identity document.
The main residence bases are work, self-employment, study, or sufficient resources plus comprehensive health insurance. A qualifying family member accompanying or joining an EU/EEA/Swiss citizen who meets a basis can also have residence rights.
-
Show eligible European citizenship Check which rules cover your work, studies, financial support, or other reason for staying.
-
Gather the required records Use employment, business, enrollment, funds, and insurance records as needed.
-
Register if staying over three months Apply within the required period after arrival. Keep records for a later permanent-residence application.
The registration certificate is not a photo ID. Non-EU family members have a separate residence-card process.
Eligibility
EEA means the EU countries plus Iceland, Liechtenstein, and Norway.
Worker or self-employed person
An employee can use a Spanish employment declaration or certificate, registered contract, or Social Security evidence. A self-employed person can use registration in the economic-activities census, commercial register, or Social Security system. EU law can preserve worker status in specified cases of involuntary unemployment, temporary incapacity, or vocational training, but the evidence and time limits matter.
Person with resources
A person who is not working must show sufficient resources for themself and family so they will not become a burden on Spanish social assistance, plus public or private health insurance covering all risks in Spain. Spain must consider the applicant's personal circumstances; it should not apply a single automatic amount without that assessment.
Student
A student must be enrolled at a recognized public or private establishment, hold comprehensive health insurance, and declare or prove enough resources for themself and family. The covered family group is narrower for a student than for some other free-movement situations, so check the relationship rules.
Family basis
EU/EEA/Swiss family members register as Union citizens in their own right. A non-EU family member generally applies for a residence card of a family member of a Union citizen. The sponsor must normally be exercising a qualifying free-movement basis, and the applicant must prove the relationship and dependency where relevant.
Registration for residence over three months should be requested personally within three months after entry. Spain also requires municipal registration (padrón) for the local residence process.
What This Route Allows
It allows an EU/EEA/Swiss citizen who meets the conditions to reside in Spain and work or be self-employed without a Spanish work permit. Qualifying family members can accompany or join the citizen under the applicable registration or family-card procedure.
After five years of legal, continuous residence, the citizen and qualifying family can acquire permanent residence. Certain workers can acquire it earlier in retirement, permanent-incapacity, or cross-border work cases. Temporary absences normally do not interrupt continuity within the limits in Royal Decree 240/2007.
Permanent residence is a legal right if the conditions are met; obtaining the permanent certificate or card documents it. Permanent residence can be lost after more than two consecutive years outside Spain.
What This Route Is Not
- It is not a visa or a way for a non-EU citizen to claim EU rights without a qualifying citizen-family relationship.
- It is not enough simply to hold an NIE; the NIE is an identifier, not proof of a residence basis.
- It is not guaranteed merely because someone is looking for work. Jobseekers have EU-law protections, but registration and continued residence turn on the facts and evidence.
- It is not the family-of-Spanish-citizen authorization under Spain's general immigration regulation, which is a different regime in many cases.
- It is not Spanish nationality.
Next Steps
- Confirm that the passport is from the EU, an EEA state, or Switzerland and decide which residence basis applies.
- Gather the matching evidence: employment/Social Security records, self-employment registrations, study enrollment, or resources and comprehensive insurance.
- Gather marriage, partnership, birth, custody, or dependency documents for accompanying family, with translation or legalization (official checks confirming a document's origin for use abroad) where required.
- Register on the municipal padrón and book the responsible police or foreigners-office appointment.
- Apply for the registration certificate within three months of entry; a non-EU family member should apply for the appropriate family residence card.
- Preserve evidence of legal residence and absences for the five-year permanent-residence stage.
