Summary

Italy reopened a limited declaration route for some former Italian citizens under Law 74/2025. Eligible former citizens can reacquire citizenship through a consular declaration during the 2025-2027 window, but the reacquisition is not retroactive and does not automatically pass citizenship to descendants living abroad.

Could this pathway work for you?

Eligibility

For the temporary route, the applicant must personally have held Italian citizenship and lost it under former Law 555/1912 Article 8(1), Article 8(2), or Article 12. Those provisions cover specified voluntary foreign naturalizations or renunciations abroad and certain derivative losses by a minor. A person who never personally held Italian citizenship cannot use this declaration as a substitute for descent recognition.

The former citizen must also have been born in Italy or have completed two continuous years of residence there. The declaration must reach the responsible Italian authority by December 31, 2027. Official guidance sets a €250 contribution.

Evidence normally includes the applicant's Italian birth or citizenship records, proof of the precise loss date and legal basis, foreign naturalization records, current identity and citizenship documents, family-status updates, and—if born abroad—historical proof of two continuous years in Italy.

More about this route

This temporary route is separate from the ordinary reacquisition rules in Article 13 of Law 91/1992, some of which depend on returning to reside in Italy.

The temporary declaration route has both historical and filing limits
  1. Historical loss Prove a qualifying personal loss Confirm former Italian citizenship and the specified old-law loss no later than August 15, 1992.
  2. Supporting history Prove the required Italian connection Establish birth in Italy or at least two continuous years of Italian residence.
  3. By December 31, 2027 Complete the declaration in time Use the consulate responsible for the application or comune and its current evidence and payment instructions.

This temporary route restores citizenship from the day after a valid declaration, not retroactively through the period of loss. The ordinary Article 13 routes have different conditions.

What This Route Allows

A valid declaration restores Italian citizenship from the day after the declaration. From then, the person has Italian citizen status and may obtain Italian identity and passport documents and exercise EU free-movement rights.

What This Route Is Not

Reacquisition under the temporary rule is not retroactive. It does not make the person continuously Italian between the old loss and the new declaration, and it does not automatically make an adult child abroad Italian.

It is not available simply because an ancestor lost Italian citizenship. Descendants must have their own legal basis. People outside the temporary conditions should examine the ordinary Article 13 rules rather than assuming no reacquisition route exists.

Next Steps

  1. Obtain proof that you personally held Italian citizenship.
  2. Identify the exact date, facts, and old legal provision under which it was lost.
  3. Prove birth in Italy or two continuous years of Italian residence.
  4. Update marriage, divorce, and other birth, marriage, and other family records needed by the consulate or comune.
  5. Book the declaration procedure with the authority responsible for the application well before December 31, 2027 and confirm its current document and payment instructions.
  6. If the temporary rule does not fit, check the separate Article 13 reacquisition provisions.
