Eligibility
The main applicant must be 55 or younger and have at least 3 years of acceptable paid business experience. That experience can be self-employment in a commercial business, charity, or non-governmental organization with at least 5 full-time employees or NZD 1 million annual revenue. Alternatively, senior-management experience can qualify where the applicant directly managed at least 5 full-time staff in an organization with at least NZD 5 million in annual revenue.
The business you plan to buy must normally:
- have traded for at least 5 years and be operating lawfully in New Zealand;
- employ at least 5 full-time-equivalent staff;
- have a qualifying purchase price of at least NZD 1 million, excluding goods and services tax (GST) and property value; and
- leave the applicant with at least 25% ownership.
The applicant must intend to run the business actively and create at least one additional ongoing full-time job for a New Zealand citizen or resident. Investment funds must be owned and lawfully acquired. The applicant must speak and understand English, be fit and proper, and meet health, character, and any required professional registration.
What This Route Allows
The work visa can last up to 4 years. Its first 12 months are an establishment stage; evidence that the business was purchased and operation began must normally be supplied within 9 months. One renewal of up to 2 years may be available if more time is needed to meet the resident-visa rules.
Residence may be available after actively operating the approved business for:
- 3 years with at least NZD 1 million invested; or
- 12 months with at least NZD 2 million invested.
The fast-track resident visa has conditions that continue until the business has been operated for at least 3 years in total. Residence also requires the business to keep paying its debts and meeting its legal obligations, retain at least 5 full-time-equivalent staff, maintain the additional job for at least 12 months, maintain the approved ownership share, and normally show 184 days in New Zealand for each relevant year.
The work and resident applications can include a partner and dependent children. The resident visa permits indefinite work and study; permanent residence is a later step after the resident conditions and time requirements are met.
What This Route Is Not
This is not passive investment, a start-up-idea visa, or permission to count the business's land, GST, professional fees, or transaction costs toward the minimum investment. Certain businesses and arrangements are excluded, and checking the business thoroughly does not guarantee immigration approval.
It is also not the Active Investor Plus Visa, which has higher investment thresholds and does not require day-to-day operation of one purchased business.
Next Steps
- Verify the applicant's 3-year business-experience record against INZ's exact definitions.
- Identify a qualifying business and arrange independent checks of its legal, tax, financial, employment, and immigration position.
- Separate the qualifying purchase investment from the NZD 500,000 reserve and trace the lawful source and ownership of both.
- Build a plan for active management, 184-day presence, maintaining 5 staff, and creating one additional ongoing role.
- Apply for the work visa, then record the 9-month purchase-evidence deadline and the later business and residence deadlines.
