New Zealand Repeat Resident Visa

New Zealand Residency
Pathway overview

At a glance

Some former New Zealand residents can recover residence after their visa expired because of travel. Eligibility depends on their rights and circumstances when it expired, how much time has passed, or a qualifying New Zealand-citizen partnership. Apply before traveling back to New Zealand.

Who may qualify
Former New Zealand residents whose visas expired for the specified travel-related reasons
Eligibility when the visa expired
You qualified for permanent residence, or for return-travel permission that would still be valid when applying now
Timing
Normally within two years for the permanent-residence option; travel-condition cases vary

Summary

A former New Zealand resident may be able to obtain a second or subsequent resident visa, depending on when and why the earlier resident visa expired. The available route depends on whether the person could then have qualified for permanent residence or renewed travel conditions, together with evidence of commitment to New Zealand. Different expiry histories use different time limits.

Could this pathway work for you?

Eligibility

The applicant must previously have held a New Zealand Resident Visa that expired because they left New Zealand after their travel conditions expired, or were outside New Zealand when those conditions expired. They must apply for the new visa before traveling to New Zealand.

At the time the earlier visa expired, the applicant must have been eligible for either:

A separate rule can assist some partners of New Zealand citizens where the earlier residence was based on that partnership or the couple have lived together for at least 12 months. The citizen partner must support the application and the couple must show that they are currently living together in a genuine relationship.

Any partner or dependent child included in the new application must have been included in the original residence application. The applicant must meet identity and character requirements and provide evidence for the relevant ties to New Zealand or partnership.

Returning after New Zealand residence expired
  1. Find the old visa and travel records Establish exactly when and why residence expired.
  2. Check the rules that apply to that date Assess permanent-residence eligibility, travel rights, or the citizen-partner exception.
  3. Apply before returning to New Zealand Provide the required records and check the new visa’s conditions.

Having held residence in the past does not by itself establish eligibility.

What This Route Allows

The visa again permits indefinite residence, work, and study. Its travel conditions reflect what could have been granted when the former visa expired. If the person was eligible for permanent residence when the old visa expired, the new travel conditions generally last 24 months from that expiry date. Under the New Zealand-citizen-partner rule, travel conditions are generally valid for 24 months.

Any extra conditions attached to the earlier visa under section 49 continue to apply. Permanent residence remains a separate application.

What This Route Is Not

It is not for someone who held only a work, student, visitor, or other temporary visa. It is not automatically available because the person once had residence, and it cannot be used after traveling to New Zealand as though the expired visa were still valid.

The important deadlines are not simply “within 3 months” or “while inside New Zealand.” The applicable test is the 2-year permanent-residence route or whether a change to travel conditions available when the old visa expired would still be valid now.

Next Steps

  1. Obtain the earlier resident visa, first-entry date, travel-condition expiry, and travel history.
  2. Identify exactly why and when the visa expired.
  3. Reconstruct whether permanent residence or a variation of travel conditions was available on that date.
  4. Gather the relevant presence, tax, investment, business, base, or New Zealand-partnership evidence.
  5. Confirm that any family member was included in the original residence case.
  6. Apply and obtain the new visa before traveling to New Zealand.
