Summary

This is a renewable 365-day residence category for dependent or independent work in Peru. It requires a qualifying contract or relationship lasting at least one year; see Migraciones' official Worker Resident page.

Worker residence normally lasts 365 days. A continuing job does not automatically renew it; you must apply for an extension.

Check the contract before applying
  1. Confirm the job or services arrangement Distinguish employment, a public administrative relationship, or qualifying independent contracted services.
  2. Check the term, signing permission, and employer Confirm the resident-category contract rules, any probation issue, lawful signing in Peru, and the entity’s RUC status.
  3. Choose the process for your location Apply from abroad or use an eligible in-country change process with the supporting work and personal records.

Short or probationary contracts can require the temporary-worker category. This is not an open permit for unrelated work or the separate concept of foreign remote employment.

The listed options are:

Documents and where to apply

An application from abroad generally needs the form, fee details, passport, contract, proof of the employer representative’s authority, and background records from your country of origin and countries of residence during the five years before arrival.

The employer or contracting organization must have an active, compliant tax registration (RUC) with Peru’s tax authority, SUNAT.

For an in-country change, the checklist also includes an INTERPOL record issued within six months and the required background declarations or records. If you sign the contract in Peru, your status must allow you to sign it, or you must first obtain the specific permission to do so. Check the requirement for a recently issued or approved contract before relying on an old copy.

If someone other than the employer’s general manager signs, provide the representative’s details and the registered authority to hire. An offer email, unsigned draft, or foreign employer without a qualifying Peruvian contracting arrangement is not enough.

What This Route Allows

Once approved, worker residence allows the holder to perform the paid activity supported by the qualifying employment, public-sector, or services arrangement and to live in Peru during the authorized period. It supports foreigner registration, a foreign-resident identity card (Carné de Extranjería), and multiple entries while the status and documents remain valid.

The law covers both employment and self-employment, so the route is not limited to a payroll employee. The evidence must nevertheless match the claimed form of work. An independent applicant should expect a genuine service contract rather than treating the category as a general permission to look for clients after arrival.

Migraciones' current renewal page says the status is extended for 365 days and instructs the holder to apply during the 30 days before expiration. Renewal evidence includes a continuing contract or relationship and current records showing that the requirements are met. Lawful resident time may later be relevant to permanent residence or nationality, but those are independent applications with their own continuity, income, and status tests.

What This Route Is Not

This is not an unrestricted open-work permit detached from the evidence used to obtain it. Material changes to the employer, contract, or type of activity can require an immigration update or a different category. Confirm the consequences before ending the supporting relationship or starting unrelated work.

It is not the proper resident route for a short contract or a contract with a probation period. Migraciones specifically directs those cases to temporary-worker assessment. It is also not Peru's digital-nomad category: remote employment generated abroad with a company outside Peru is a different legal concept and should not be forced into a local worker-resident file.

The 365-day grant is not permanent residence, and it does not make family members residents automatically. A spouse, child, or other qualifying family member normally needs a separate family-resident application and their own civil and background documents.

Finally, immigration approval does not replace labor-law, professional-licensing, payroll, social-security, or tax compliance. The employer and worker must satisfy those rules separately.

Next Steps

  1. Confirm whether you are applying through employment, a public-sector job, or independent services.
  2. Check the one-year minimum and whether a probation clause means you need the temporary-worker category.
  3. Confirm the employer’s active RUC registration and who has authority to sign.
  4. Before signing in Peru, check that your status allows it or obtain the required permission.
  5. Choose the process for your location and gather the current contract, employer records, passport, background documents, and any required INTERPOL evidence.
  6. Arrange authentication and translations, apply through the Agencia Digital, and monitor requests.
  7. After approval, complete the residence-card process. Plan to apply for renewal during the 30 days before your permission expires.
