Summary
Since 19 May 2026, a person adopted by a Portuguese citizen acquires Portuguese nationality by making a declaration. It is no longer described in the Nationality Law as automatic nationality on adoption.
The adoption must be legally valid for Portuguese purposes. A foreign adoption may first need recognition or registration in Portugal.
-
Portuguese adoptive parent Document the parent's nationality and the complete adoption record.
-
Legal recognition Confirm any Portuguese recognition or registration of a foreign adoption.
-
Declaration to become a citizen Submit through the authorized procedure with the required records.
The resource describes declaration-based acquisition from May 19, 2026, rather than automatic nationality on adoption.
Eligibility
This route may fit if:
- a Portuguese citizen legally adopted you;
- the adoption creates the parent-child relationship recognized by Portuguese law;
- you can prove the adoption and the adoptive parent's Portuguese nationality; and
- no applicable opposition, public-security, or document-integrity issue prevents acquisition.
Guardianship, foster care, informal care, or a step-parent relationship without a qualifying adoption is not enough.
What This Route Allows
After the declaration is accepted and registered, you become a Portuguese citizen and therefore an EU citizen, with EU free-movement rights. The nationality result is separate from any residence status held before the application.
What This Route Is Not
This is not ordinary descent through a biological parent and not a residence visa. It also does not make every foreign adoption immediately usable: recognition of the adoption may be a necessary first step.
Applications already pending on 19 May 2026 are governed by the earlier version of the law.
Next Steps
- Obtain the complete adoption judgment or civil record and evidence that it is final.
- Obtain the adoptive parent's Portuguese birth or nationality record.
- Ask a Portuguese civil registry whether the foreign adoption must first be recognized or transcribed.
- Legalize and translate foreign records as the registry requires.
- Submit the nationality declaration through an authorized Portuguese registry, consulate, or represented online process.
