- Commonwealth citizens settled before January 1, 1973, qualifying children, and some people of any nationality who arrived before the end of 1988
- Cost
- Free to apply
- Evidence
- Records establishing identity, arrival, and residence; the authority can consider a combination of records
Summary
This is a documentation and status route for people settled in the UK who lack evidence of their right to be there. GOV.UK covers people who came from a Commonwealth country before 1973, children of such people, and people who came from any country before 31 December 1988 and are now settled in the UK.

Eligibility
The detailed tests vary by group. A Commonwealth citizen who settled before January 1, 1973 can qualify. Their child may qualify if born in the UK or if they arrived before age 18 and have lived here continuously. A parent with right of abode can also qualify the child. The continuity rule does not apply when the child was already British, or a citizen of the UK and Colonies, from birth. A person of any nationality who arrived before the end of 1988 may qualify for proof of settlement. Residence and absence history matter, and a person outside the UK has narrower application rules.
The task is to prove identity, arrival and continuing residence with whatever records remain. The Home Office Windrush team can search government records and should not demand one ideal document where a combination establishes the facts.
What This Route Allows
Depending on existing entitlement, the applicant may receive a status letter or access to an eVisa proving the right to live and work. Eligible Commonwealth applicants can register or naturalize as British without nationality application or ceremony fees. The status itself does not require renewal, but digital account and passport details must be maintained.
What This Route Is Not
It is not a new visa for any Commonwealth citizen and does not automatically give citizenship. The Windrush Compensation Scheme is a separate application for losses caused by inability to prove status; a successful status application does not automatically award compensation.
Next Steps
- Call the Windrush Help Team before paying for another immigration or nationality application.
- Build a timeline using passports, school, NHS, National Insurance, work, tax, tenancy and benefit records.
- Explain missing evidence and authorize government-record checks.
- After status is confirmed, separately assess free citizenship and any compensation claim.
