Summary

This route covers citizenship through adoption by a South African citizen. It is document-heavy: the adoption must be legally recognized, the adoptive parent's South African citizenship must be proven, and the birth or adoption record must support the citizenship claim.

Eligibility

Section 3 of the Citizenship Act requires:

Prepare the final adoption order, original and post-adoption birth records where available, the parent's South African identity and citizenship records, and any name-change documents. Home Affairs may need more information to record the birth and adoption correctly.

If the adoption took place abroad, confirm that South Africa recognizes it under the Children's Act. The process can depend on whether the other country participates in the Hague Convention on intercountry adoption and on the relevant court orders. Complete that recognition process before assuming citizenship documents can be issued.

Citizenship through adoption by a South African
  1. Confirm the legal adoption Check the parent’s citizenship and recognition of any overseas order.
  2. Register the birth and adoption Complete the Home Affairs record and resolve identity differences.
  3. Apply for documents Follow the separate birth-certificate, identity, and passport procedures.

Informal care or guardianship does not replace a qualifying legal adoption.

What This Route Allows

Once section 3 is satisfied, the adopted person is a South African citizen. The law calls this citizenship by descent. After Home Affairs records the birth and status, the person can apply for a birth certificate, an identity document when eligible, and a passport.

Citizens have the right to enter, remain in, and live in South Africa and to a passport. Each document application still requires the appropriate identity and consent evidence.

What This Route Is Not

Guardianship, foster care, custody, customary care, or an informal family arrangement is not the legal adoption required by section 3. The adoptive parent must already be South African; the child's adoption does not give the parent citizenship.

An adoption order does not automatically register the birth or provide every record Home Affairs needs. Disputes about identity, parentage, or recognition of a foreign order may need further legal steps.

Next Steps

  1. Obtain a certified final adoption order and all available original and amended birth records.
  2. Confirm the adoptive parent's South African citizenship on the relevant date.
  3. For an overseas adoption, obtain confirmation of recognition under the Children's Act.
  4. Register or update the birth and adoption with Home Affairs and resolve name or identity differences.
  5. Apply separately for the appropriate citizenship, identity, and passport documents once the population record is complete.
