Belgian Citizenship by Marriage Declaration
At a glance
If you are married to a Belgian and have lived legally in Belgium for five years, you may qualify to apply for citizenship by declaration. Marriage alone does not give citizenship. You must also meet the shared-home, language, integration, and residence-status requirements.
- Relationship
- Legally married to a Belgian citizen
- Residence
- Usually 5 years of legal residence in Belgium and 3 years living together there after marriage
- Other requirements
- Basic language ability, social-integration proof, and unlimited residence when filing
Summary
Marriage to a Belgian citizen can support a nationality declaration after five qualifying years of legal residence in Belgium. Within that route, the couple normally must have lived together there as spouses for at least three years. The applicant must be an adult with an unlimited right to remain when filing.
Accepted evidence of language ability and social integration remains necessary. The municipality checks the residence and shared-home records as well as the marriage. Three years of marriage abroad does not substitute for the Belgian residence conditions, and family-reunification residence is a separate earlier process.
-
Check your residence Document five years of qualifying legal residence and an unlimited right to stay at filing.
-
Prove married life Show at least three years of living together in Belgium, plus accepted language and integration evidence.
-
File at your commune When all conditions are met Submit the nationality declaration for the required checks.
The three years of living together form part of the five-year residence route; they are not an extra three years added afterward. Marriage alone does not grant citizenship.
Eligibility
The marriage category generally requires:
- Age 18 or older.
- Main residence in Belgium when the declaration is made.
- An unlimited right of residence when filing.
- Five years of legal residence in Belgium under the nationality rules.
- A marriage that is legally valid and recognized in Belgium.
- At least three years of living together in Belgium as spouses.
- Knowledge of Dutch, French, or German shown by an accepted form of proof.
- Social integration shown by an accepted route.
FPS Justice lists the social-integration routes for this category as a qualifying Belgian diploma or certificate, an accepted integration course, or at least 400 hours of recognized vocational training combined with at least 234 days of employee or public-service work in the last five years, or at least three quarters of Belgian social-security contributions as a principally self-employed person.
Proving social integration also proves the language condition under the official guidance. The commune should confirm exactly which document is accepted in the applicant's region and situation.
More about this route
The official FPS Justice summary requires five years of legal residence, knowledge of one of Belgium's three national languages, marriage to a Belgian with at least three years of living together in Belgium, and proof of social integration. The same category also covers the parent or adoptive parent of a Belgian child under 18, which is explained separately in the parent-of-a-Belgian-child resource.
At filing, the applicant must have their main residence in Belgium and an unlimited right of residence. During the required period immediately before filing, the residence must be based on a right to stay for more than three months. The commune checks the residence record and the current card; a marriage certificate does not replace those requirements.
The federal fee for obtaining citizenship is currently shown by FPS Justice as €1,000, paid before filing. Because the amount is legally indexed, applicants should confirm the payable figure with FPS Finance or the commune immediately before payment.
What This Route Allows
When the declaration is accepted and entered in the records, the applicant becomes Belgian. The person can obtain Belgian citizen identity and passport documents, live and work in Belgium without an immigration permit, and exercise EU citizenship rights.
Belgium permits multiple nationality, but applicants should separately check whether their existing country treats voluntary acquisition of Belgian nationality as a loss event.
What This Route Is Not
This is not citizenship on the wedding day, a three-year marriage-only rule, or a route that can normally be completed while the couple lives abroad. The three years of living together is an additional condition within a five-year legal-residence route in Belgium.
It is not the same as residence through family reunification. A spouse who has not yet built the required residence first needs the appropriate family residence status. Nor does marriage waive the language and social-integration evidence.
At filing, the applicant must be an adult and hold an unlimited right to stay. For a route requiring language knowledge, a willingness to learn later is insufficient; accepted social-integration evidence can also establish language knowledge under the official rules.
Next Steps
- Ask the commune for a review of the five-year legal-residence period and confirmation that the current right of residence is unlimited.
- Obtain a Belgian marriage record or complete any required recognition or transcription of a foreign marriage.
- Request commune records showing at least three years of living together in Belgium as spouses.
- Choose the strongest accepted integration proof and confirm that it also establishes language knowledge in the file.
- Gather the family-status, residence, and work or training records requested by the commune; obtain legalization (official checks confirming a document's origin for use abroad) and translations only as instructed.
- Confirm the current indexed registration fee and pay it through the official FPS Finance method before filing.
- Make the declaration before the civil registrar in the commune of main residence. The commune sends a complete file to the royal prosecutor, Immigration Office, and State Security; the prosecutor has four months from the acknowledgment of a complete file to object.
