Luxembourg Citizenship Through Marriage

Luxembourg Citizenship
Pathway overview

At a glance

Luxembourg has an option procedure for some spouses of Luxembourgish citizens. It generally depends on the spouse's Luxembourgish nationality, the couple's situation, language and civic-integration requirements, and good character.

Summary

A person married to a Luxembourgish citizen may be able to become a Luxembourgish citizen through the country's “option” procedure. Here, option means a formal citizenship declaration available to people in listed situations; it does not mean that citizenship begins automatically on marriage.

The spouse route still requires Luxembourgish language ability, completion of a civic course or test, and an acceptable criminal and personal history. A person living outside Luxembourg normally also needs 3 years of marriage before making the declaration.

From marriage evidence to an option declaration
  1. Marriage and nationality Document a valid marriage and your spouse’s Luxembourgish nationality.
  2. Language and civic preparation Complete the required Luxembourgish examination and civic course or test.
  3. Declare the option Subject to all conditions Submit the family-status and good-repute records personally to the responsible registrar.

Applicants living abroad normally need three years of marriage, with a specific public-service exception. Marriage does not itself grant nationality or residence.

Eligibility

The applicant must be married to a Luxembourgish citizen and must:

There is no stated minimum marriage duration for an applicant resident in Luxembourg. An applicant who does not reside in Luxembourg can acquire nationality only after three years of marriage immediately before the option declaration. That three-year period does not apply where the couple lives abroad because the Luxembourgish spouse performs a function conferred by a Luxembourg public authority or an international organization.

The file normally includes identity and birth, marriage, and other family records, the marriage record, proof of the spouse's Luxembourgish nationality, language and civic certificates, and the required foreign criminal-record certificates. A foreign marriage may first need to be entered correctly in Luxembourg's birth, marriage, and other family records.

The declaration is made in person before the civil registrar for the applicant's commune. The registrar sends the complete file to the Ministry of Justice. Missing documents can delay the date on which the Ministry treats the file as complete.

What This Route Allows

If the Minister does not object, the applicant becomes Luxembourgish 4 months after the Ministry of Justice receives the completed option file. Citizenship starts then; it is not backdated to the wedding or the filing date.

The option procedure itself is free. Luxembourg generally permits multiple nationalities, but another country may apply its own loss or disclosure rules.

What This Route Is Not

This is not a fiancé route, residence visa, or shortcut around the rules for recognizing a foreign marriage. A spouse who needs permission to live in Luxembourg must separately use the appropriate family-residence process.

Marriage duration alone cannot replace the language, civic and good-repute conditions.

Next Steps

  1. Confirm the marriage is valid and properly documented in Luxembourg.
  2. Obtain current proof of the spouse's Luxembourgish nationality.
  3. Complete the language examination and civic course or test.
  4. Order family-status and criminal-record evidence and accepted translations.
  5. Make the option declaration personally before the responsible civil registrar.
