Summary

If you are the foreign spouse or child of a Paraguayan citizen, a special procedure may let you apply directly for permanent residence without temporary residence first.

The process can involve the Repatriates Secretariat, the National Police Identification Department, and the Migration Directorate. Confirm their required sequence before starting. This particular route does not cover unmarried partners, extended relatives, foreign parents of Paraguayan children, or relatives of foreign residents.

Apply through your Paraguayan spouse or parent
  1. Confirm you qualify as a spouse or child Prove a legally valid marriage to a Paraguayan citizen or that you are the foreign child of a Paraguayan parent.
  2. Prepare the special family documents Resolve civil-record differences and follow the identity, authentication, and any minor-child consent requirements.
  3. Apply directly for permanent residence Use the special procedure without the ordinary temporary-residence stage, then maintain the required identity documents.

This category does not cover an unmarried partner or the foreign parent of a Paraguayan child. A child should separately check nationality by option. Permanent status is indefinite, but its physical card must be renewed.

Eligibility

Foreign spouse

The applicant must prove a legally valid marriage to a Paraguayan citizen. The application will normally need the Paraguayan spouse's identity record and the marriage record. If the marriage occurred abroad, the record must be legalized or apostilled and translated into Spanish when required.

An informal partnership or plans to marry do not satisfy the spouse category. If names or civil status differ across records, resolve the inconsistency before relying on the route.

Foreign child

The applicant must prove that the applicant's father or mother is Paraguayan. The current official page describes “foreign children” and does not limit the basic Law No. 2193 category to minors. A minor's application has extra consent, signature, identity, custody, or authorization requirements depending on who accompanies the child.

The child should also check the separate nationality-by-option route. A foreign-born child of a Paraguayan natural parent may be able to obtain Paraguayan natural nationality after becoming permanently settled in Paraguay and completing the court process. Residence and nationality are different procedures.

The three agencies involved

The Migration Directorate describes this sequence:

  1. Request a Repatriation Certificate from the Secretariat for Repatriates and Refugee Nationals.
  2. Use the family-law documentation process at the National Police Identification Department to obtain a Paraguayan identity card.
  3. Apply personally to the Migration Directorate for the permanent-resident card.

The official page says an applicant may begin with the Repatriation Certificate and explains the fee benefits attached to it. Its final residence checklist also asks for that certificate and the identity file sent by the Identification Department. Confirm the exact sequence with the agencies before starting, especially if not requesting the fee exemption.

If the identity card is issued first under this process, the permanent-residence application must begin within 90 days after the card's issue date.

Who may qualify for a fee exemption

With the Repatriation Certificate, a foreign child of a Paraguayan and a foreign spouse whose marriage occurred abroad can receive the stated migration-fee exemption. A spouse whose marriage occurred in Paraguay does not receive that specific residence-fee exemption under the current official page. Government charges can change, so check the agency page when filing.

What This Route Allows

An approved applicant receives permanent residence directly, with no two-year temporary-residence stage. The permanent-resident card documents indefinite immigration status, although the physical card must be renewed every 10 years.

Permanent residence also gives access to the ordinary identity, work, study, and other lawful activities available to permanent residents. The special identity-card-first sequence is a feature of this family process; it should not be generalized to other residence categories.

The residence period may later be relevant to a separate naturalization application. It does not itself grant citizenship, shorten the Constitution's published three-year permanent-admission requirement, or guarantee Supreme Court approval.

What This Route Is Not

This route is not:

Other family situations may fit a different residence or rule for financial support of dependents, but they should not be described as Law No. 2193 direct residence.

Next Steps

  1. Confirm the exact relationship. Obtain the Paraguayan relative's current identity or nationality record and the full marriage or birth record that proves the link.
  2. Correct record differences early. Compare names, surnames, dates, and parents across every document.
  3. Prepare foreign documents. Obtain the required apostille or legalization and Spanish translation. Brazilian documents in Portuguese have the translation treatment stated on the current Migration Directorate page.
  4. Contact the Repatriates Secretariat. Ask whether the Repatriation Certificate is available for the facts and what original documents it requires.
  5. Confirm the identity-document records. The permanent-residence process relies on the authenticated identity-file copy that the Identification Department sends to the Migration Directorate.
  6. Track the 90-day deadline. If the Paraguayan identity card is issued through this sequence, start the permanent-residence case within 90 days.
  7. Plan for personal attendance. The Migration Directorate states that the application is personal and in person. A representative may follow the case, but does not replace the applicant at filing.
  8. For a minor, check consent and custody records. Requirements differ when one parent, both parents, or a third party accompanies the child.
  9. Check nationality separately if the applicant has a Paraguayan parent. Residence may not be the only relevant route.
