Spain Employee Work Visa

Spain Residency
Pathway overview

At a glance

Non-European workers with an eligible Spanish job can apply through the employer-led employment route. Hiring approval, the contract, and the worker's immigration documents all form part of the process.

Job offer required?
Yes; national-employment rule or exception must be met
Requirements
An approved employment contract and the qualifications or recognition required for the job
Salary requirement
Applicable wage rules; part-time contracts must still meet the full-time annual minimum

Summary

A Spanish job offer may allow you to apply to live and work in Spain if you are not an EU, EEA, or Swiss citizen. The employer normally applies first. After approval, you complete any required consulate visa process, enter Spain, and arrange Social Security and your foreigner identity card (TIE).

This route is most relevant when the role does not use the EU Blue Card or the Law 14/2013 national Highly Qualified Professional authorization.

The employer normally applies before the worker's visa stage
  1. Confirm the job and hiring basis Check the contract, pay, qualifications, and labor-market rule or exception.
  2. Employer requests authorization Supply employer tax, Social Security, solvency, recruitment, and worker records.
  3. Complete the visa process After authorization approval Apply at the consulate responsible for the application where a visa is required.
  4. Finish arrival required steps Complete the applicable Social Security and TIE steps.

A contract alone does not complete this residence-and-work route. The visa and arrival steps follow the relevant authorization.

Eligibility

EEA means the EU countries plus Iceland, Liechtenstein, and Norway.

The application normally requires:

The national employment situation can be satisfied through the quarterly shortage-occupation catalog, an unsuccessful public-employment recruitment process, or one of the exceptions in Article 40 of Organic Law 4/2000. A job offer by itself does not prove this requirement.

The initial authorization is generally for work lasting more than 90 days and has a maximum duration of one year. Its effectiveness normally depends on the worker being registered with Social Security after entry and within the required period.

What This Route Allows

The initial permit authorizes the approved employment and is initially limited by occupation and autonomous community unless an exception applies. Under the current regulation it can also allow secondary self-employment while the employee activity remains the main activity; an involuntary end to the main job must be reported under the applicable rule.

A qualifying renewal is generally valid for four years and authorizes both employment and self-employment anywhere in Spain and in any sector. After five years of qualifying legal and continuous residence, national long-term residence may be available.

Family members do not automatically receive status from the worker's initial application. General family-reunification rules usually apply later, subject to the sponsor's residence period, resources, housing, insurance, and relationship.

What This Route Is Not

This is not a job-search visa. Interviewing, looking for work, or having an employer unwilling to complete the authorization process is not enough.

It is not the same as an EU Blue Card or national Highly Qualified Professional authorization. Those Law 14/2013 routes use different qualification, salary, procedure, mobility, and family rules.

Next Steps

  1. Ask the employer which authorization it intends to sponsor and who will manage the filing.
  2. Confirm whether the national employment situation is satisfied or a legal exception applies.
  3. Review contract duration, hours, salary, collective agreement, work location, and required professional recognition.
  4. Have the employer collect its tax, Social Security, solvency, and recruitment evidence while the worker collects passport, criminal-record, qualification, and civil documents.
  5. After employer approval, apply for the visa within the official deadline, enter Spain during the visa's validity, and complete Social Security registration and the TIE application.
  6. Track any employer or job change and the renewal window; do not assume the initial authorization is unrestricted.
