Summary

Nigeria's marriage-based citizenship registration provision is written for a woman who is or has been married to a Nigerian citizen. It requires a recognized marriage history, good character, an intention to make Nigeria a permanent home and the prescribed oath, followed by presidential approval.

A former marriage can require review of divorce or death records and does not guarantee acceptance. The published citizenship provision does not give a foreign husband the same route; spouse residence and Special Immigrant Status are separate possibilities. Rules concerning another nationality also need checking before any renunciation.

Eligibility

Section 26(2)(a) of the Constitution describes this route for women. It does not provide the same marriage-based citizenship application for a foreign husband of a Nigerian woman. Residence options, including Special Immigrant Status, may be relevant to a spouse who is not applying for citizenship.

The President must accept your character, intention to make Nigeria your permanent home, and completion of the oath before granting the certificate. Approval is not automatic.

The Constitution includes a woman who “has been married,” but a past marriage does not guarantee approval. The Ministry may need to examine a divorce, a spouse’s death, the relationship’s authenticity, and the full marriage history.

The current checklist asks for your birth and marriage certificates, passport and residence records, evidence of how you support yourself, your Nigerian spouse’s citizenship proof, earlier-marriage information, and guarantor records. Additional documents are listed for a deceased spouse or prior marriage, and further checks may be required.

Section 28 can require you to formally give up another citizenship if you did not hold it by birth. Where required, this must take effect within the deadline after registration. Officially published copies give different deadlines, five or twelve months; obtain written confirmation from the Ministry. Later voluntary acquisition or retention of another citizenship not held by birth can also affect your Nigerian citizenship.

Applying for Nigerian citizenship through marriage
  1. Confirm the marriage and citizenship evidence Prepare a complete record of the relationship and any prior marriages.
  2. Document your plans and other requirements Show character, support, lawful residence, and plans for a permanent home in Nigeria.
  3. Apply and complete the approved citizenship steps Resolve any renunciation requirement before a separate passport application.

This constitutional route is written for women and requires government approval; marriage alone does not grant citizenship.

What This Route Allows

After the certificate, oath, and any required renunciation take effect, you become a Nigerian citizen by registration. You can apply separately for a passport and other citizenship documents.

Citizenship continues unless it is lost, given up, or taken away under the Constitution. It is different from residence permission with immigration conditions.

What This Route Is Not

There is no automatic citizenship approval simply because you marry or remain married for a certain number of years. The application still needs presidential approval and an intention to make Nigeria a permanent home.

This particular citizenship route is written for women, and it does not provide unrestricted dual citizenship where another nationality was acquired after birth.

Next Steps

  1. Gather the recognized marriage record and proof of your spouse’s Nigerian citizenship.
  2. Document any earlier marriage, divorce, death, or name change.
  3. Prepare character, lawful-residence, financial-support, and permanent-home evidence.
  4. Check how you acquired each other citizenship and obtain advice before any renunciation.
  5. Follow the Ministry’s current portal and checklist, asking the Citizenship and Business Department to clarify anything uncertain in your case.
