Portuguese Citizenship by Marriage
At a glance
If you have been married to a Portuguese citizen for more than three years, you may apply for citizenship by making a formal declaration. The marriage must still exist when you apply. An unmarried partner can also qualify after more than three years, but a Portuguese court must recognize the relationship.
- Relationship

Summary
Eligible spouses and partners of Portuguese citizens can apply for citizenship after a continuing relationship of more than three years. An unmarried union needs recognition by a Portuguese court; a foreign marriage may need entry in the Portuguese register. A resident partner without Portuguese citizenship does not establish this basis.
The declaration remains subject to the applicable background and security grounds. In certain shorter relationships without a common Portuguese child, lack of an effective connection to Portugal can also be a ground of opposition. Completing the relationship timeline therefore does not by itself guarantee nationality.
Eligibility
You generally need:
- a current marriage to a Portuguese citizen lasting more than three years; or
- a de facto union with a Portuguese citizen lasting more than three years and a court judgment recognizing the union;
- birth, marriage, and other family records proving the relationship and the Portuguese partner's nationality; and
- clearance of the applicable serious-crime, security, and sanctions grounds.
For a relationship of no more than six years without a common Portuguese child, the authorities may also oppose the case for lack of an effective connection to Portugal. That connection is assessed through language, cultural, historical, civic, democratic, support, and related integration factors. After more than six years, or where the couple has a common Portuguese child, that particular connection ground does not apply, although the serious-crime, security, and sanctions grounds remain.

What This Route Allows
After the declaration is accepted and registered, you become a Portuguese and EU citizen. The result is nationality, not merely a family residence permit.
What This Route Is Not
This route does not apply merely because a spouse or partner lives in Portugal; that person must be Portuguese. A wedding or partnership does not guarantee approval, and sham or unrecognized relationships do not qualify.
Next Steps
- Confirm the Portuguese partner's nationality and the exact relationship start date.
- Register or transcribe a foreign marriage in Portugal if required.
- For a de facto union, obtain the required Portuguese court recognition.
- Prepare birth, marriage, and other family records and, where relevant, evidence of effective ties to Portugal.
- Review background and foreign-public-service or non-compulsory military-service issues before filing.
