Portuguese Citizenship Recovery
At a glance
Portugal has limited routes for certain former Portuguese citizens to get nationality back, including some older loss situations and a route decided case by case for some people who lost Portuguese nationality and never acquired another.
- Who it covers
- Certain former Portuguese citizens
- Loss history
- Document the date and legal reason citizenship ended; covered incapacity, historic marriage, and naturalization losses have different rules
- Former citizens with no nationality
- A separate case-by-case route can apply if you never obtained another nationality and maintain effective Portuguese ties
Summary
Portuguese law has several narrow ways for a former Portuguese citizen to regain nationality. The correct route depends on how and when nationality was lost.
Examples include loss caused by a declaration made while the person lacked legal capacity (the legal ability to act for yourself), historic loss by a woman because of marriage under former law, historic loss after voluntarily acquiring another nationality, and a citizenship decision made case by case for a former Portuguese citizen who never acquired another nationality and maintains effective ties to Portugal.
-
Prove the earlier Portuguese nationality Obtain the original birth and nationality records.
-
Reconstruct the loss and later nationality history Identify the legal mechanism and every nationality subsequently acquired.
-
Confirm the correct procedure with the registry Match the case to declaration, registration, or a citizenship decision made case by case.
Reacquisition is for a former citizen. Having a Portuguese relative is a different legal basis.
Eligibility
You must first prove that you previously held Portuguese nationality and identify the legal event that ended it. The evidence and conditions then differ:
- a person who lost nationality through a declaration made during incapacity may reacquire it by declaration after gaining capacity;
- some historic marriage and foreign-naturalization losses have special transitional declaration rules; or
- a former citizen who lost Portuguese nationality, never obtained another nationality, and maintains effective ties may request a citizenship decision made case by case without the ordinary residence minimum.
Modern record, security, civic, and support conditions can apply to a citizenship decision made case by case.
What This Route Allows
If the applicable declaration or naturalization is accepted and registered, Portuguese nationality is restored or reacquired. The person also becomes an EU citizen.
What This Route Is Not
This is not a first-time ancestry application and not a general option for anyone with a Portuguese relative. A person who never actually held Portuguese nationality should examine the separate routes based on birth, a Portuguese parent or grandparent, adoption, marriage, or residence.
Next Steps
- Obtain the former Portuguese birth and nationality records.
- Identify the date, mechanism, and legal basis of loss.
- Obtain proof of every later nationality, or proof that no other nationality was acquired.
- Match the facts to the current or historic legal route before choosing a form.
- Ask a Portuguese registry to confirm whether the case proceeds by declaration, registration, or a citizenship decision made case by case.
